DMCA Policy

Frothier respects the intellectual property rights of others and expects users of our service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we respond promptly to claims of copyright infringement reported to our designated copyright agent.

Notice of copyright infringement

If you are a copyright owner (or authorized to act on behalf of one) and believe content on Frothier infringes your copyright, you may submit a written notification under the DMCA. To be effective, your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the allegedly infringing material, with information sufficient for us to locate it (e.g., the specific URL or a description).
  4. Your name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

What happens after we receive a notice

Counter-notification

If you believe material was removed or disabled as a result of mistake or misidentification, you may file a counter-notification, which must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it previously appeared.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or any district where Frothier may be found).
  5. A statement that you will accept service of process from the person who provided the original DMCA notice.

Counter-notifications should be sent to the same contact above.

Repeat infringers

Frothier has a policy of terminating access for repeat infringers in appropriate circumstances.
